Terms of Service

By accessing or using MarginTrace ("the Service"), operated by MarginTrace at margintrace.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users, including individuals, teams, and companies. We may update these Terms at any time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

MarginTrace provides software tools that connect, in read-only mode, to third-party platforms (including payment processors and AI providers) to help you analyze gross margin, LLM costs, and usage-based billing data.

MarginTrace never touches, moves, holds, or has access to your funds. All integrations are strictly read-only. We retrieve data solely to display analytics and do not initiate, modify, or cancel any transactions on your behalf.

MarginTrace is an analytics and reporting tool. Nothing provided through the Service constitutes financial advice, investment advice, legal advice, accounting advice, or tax advice.

You should not rely on MarginTrace data or reports as a substitute for the advice of a qualified financial advisor, attorney, accountant, or tax professional. All decisions you make based on information from the Service are your own responsibility.

To use certain features you may need to provide an email address. You are responsible for maintaining the security of any credentials associated with your account and for all activity that occurs under your account.

Notify us immediately at legal@margintrace.io if you suspect unauthorized access to your account.

MarginTrace may ask you to provide API keys for third-party services (such as Stripe or OpenAI). You represent that you have the right to provide these keys and to authorize MarginTrace to make read-only calls on your behalf.

API keys you provide are used only for the current session to retrieve analytics data. MarginTrace does not persist, store, or transmit your API keys beyond the scope of the immediate request. You are responsible for managing and revoking API keys at any time through the respective third-party platform.

MarginTrace is not responsible for the availability, accuracy, or security of third-party APIs or data.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any portion of the Service or its systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape, crawl, or extract data from the Service at scale.
• Interfere with the operation of the Service or its servers.

All content, software, trademarks, and materials on the Service are the property of MarginTrace or its licensors and are protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works from any part of the Service without our express written permission.

You retain ownership of any data you bring to or generate through the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

MarginTrace does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Data displayed is sourced from third-party APIs and may be delayed, incomplete, or inaccurate.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARGINTRACE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MARGINTRACE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, MarginTrace, or third parties. You may stop using the Service at any time.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

We may modify these Terms at any time by posting an updated version on this page. The "Last updated" date at the top of this page reflects when the Terms were last revised. Your continued use of the Service after the effective date of any revision constitutes acceptance of the revised Terms.
